A go-ahead was given to the application for a priority preliminary ruling on an issue of constitutionality lodged by Hervé Lehman before the Constitutional Council (Conseil Constitutionnel) regarding the Commission Nationale des Sanctions (National Enforcement Commission) and its decisions concerning notably real-estate agencies
Hervé Lehman appeared on 28/02/2017 before the Conseil Constitutionnel regarding a Priority Question on Constitutionality relating to the articles of law L. 561-41 and L. 561-42 of the Monetary and financial code) governing the Commission Nationale des Sanctions (National Enforcement Commission), the authority in charge of monitoring real-estate agencies and … casinos, and whose task consists in ensuring that the firms in these sectors implement internal anti-money laundering procedures.
Following this hearing chaired by Laurent Fabius, the Conseil Constitutionnel pronounced the articles concerned to be anti-constitutional (Decision 2016-616/617 QPC of 9 March 2017).
